Bluesonde Rental Terms

These Rental Terms supplement the Bluesonde Product Terms and Conditions (the “Terms”) and apply to Devices provided on a rental basis (“Rented Devices”). Capitalized terms not defined here have the meanings given in the Terms.
1. Ownership
Rented Devices are leased, not sold. Bluesonde retains all ownership rights in the Rented Devices at all times.
2. Use and Care
Customer will use the Rented Devices only for their intended purpose and with reasonable care. Customer will not modify, disassemble, sell, sublicense, or transfer the Rented Devices without Bluesonde’s prior written consent.
3. Risk of Loss and Damage
Customer assumes responsibility for loss, theft, destruction, or damage to the Rented Devices from the time of delivery until returned to Bluesonde, except to the extent caused by Bluesonde’s gross negligence or willful misconduct.
Customer will promptly notify Bluesonde of any loss or damage.
If a Rented Device is lost, destroyed, not returned, or damaged beyond reasonable repair, Customer will pay the replacement cost specified in the applicable Order or otherwise provided by Bluesonde.
4. Return of Devices
Upon expiration or termination of the applicable Order, Customer will promptly return the Rented Devices to Bluesonde in good working condition, reasonable wear and tear excepted.
Customer is responsible for return shipping unless otherwise agreed in writing.
5. Priority
These Rental Terms supplement the Terms and control in the event of a conflict relating to Rented Devices.
By renting Bluesonde Devices, you acknowledge that you have read and understood these Rental Terms and agree to be bound by them.
